I agree that the email does not expressly say that. I am willing to bet that Houston is in. Look, Texas wants Houston in. Therefore Houston gets in. It is that simple.

I guess the networks would argue that they assumed they would be paying for expansion additions from another P5 conference in case the Big12 was able to break off FSU or Notre Dame like in their dreams. Unless the language of the contract specified that it's hard to imagine they'd have any case. But they could use the threat of a dragged out expensive legal process as negotiating leverage to get the Big12 to the table and agree to a modest bump in revenue to stay at 10 instead of expanding and enforcing the more expensive expansion clause. Not hard to see the Big12 accepting that based on their proclivity for inaction: "you mean we don't have to do anything different or add anything and we get paid more right now? Future be damned, I'm in."
Because ESPN doesn't want to shell out the money.
