I think the idea was to remove the possibility of campaign finance infractions. Now it's just a lie and he can come out with a statement about how "I lied to protect my wife, it's a personal matter, I had a lapse in judgment, etc". They got out ahead of it to keep Trump from lying under oath about it, had it ever gotten that far.
