I kind of expect that often happens in a court full of 70 to 85 year olds. The press will make a big deal of it being Thomas, if it was Ginsberg we would never had heard about it.
Clarence is 67. It's long been rumored that he nods off when court is in session and he asked his first question in 10 damn years this year. 10. damn. years.
And let's not forget that he also fell asleep during Obama's inauguration in 2009.

I doubt that. There would plenty of opportunity for people to go after Ginsburg or any other justice too. Maybe the facts just don't support the idea that Ginsburg is nodding off. If you read his opinions, you'd know that he's at least engaged. He preferred to let Scalia and others take the lead and that was his style. Once Scalia passed, he got a bit more active.
