There also is an exemption to sell fireworks for agriculture purposes, specifically “in frightening birds from agricultural works and fish hatcheries.”

Many fireworks stands require shoppers to sign a waiver, stating that the fireworks can only be used under that specific exemption.

“The waiver is basically putting the responsibility back on the consumers and saying that they understand the laws,” Nicholls said.

Law enforcement’s hands are tied because Florida courts have ruled that fireworks retailers aren’t responsible for making sure their products are used for their intended purposes.

You can’t in Miami Dade but many counties you can. Just need to sign that waiver. I thought you could in Orange.
