FYI, Weinstein’s already had one set of charges dismissed because the prosecution didn’t turn over exculpatory evidence. With that said, I still think he’s a douchebag and that he probably is guilty of most of it. But we really do need to pump the brakes on ruining people’s lives before all of the facts are in.

Yes, here in Florida.

This isnt two people arguing and she takes a shot at him.

Again, I said he instigated an issue, and that alone is something he should be arrested for (before the return battery).
But she decided to actually assault him first.

It would have been one thing had he actually accosted her directly.
But she decided to get out and not just confront him, but strike him.

Assault is assault, and charges should be filed.
He should get far more charges, let alone because of the battery.

But if she was a man, she would have been arrested for assault (even without battery).
This is the problem with the US courts right now, and judges and lawyers know it.

But the daughter should still be charged with assault afterwards.

People should not assault other people, especially people clearly who have a problem in the first place.
Again, if this woman was a man, she would have been charged as well.

I don't think she should even be charged with battery, just assault. Enforcement of laws are about deterrent. It's completely non-PC, but until we hold women accountable, assaults by women will continue to increase. We have to showcase how all Americans, regardless of sex, will be held accountable, and no one gets any pass.

Now had he actually assaulted her (battery or not) first, then she shouldn't be charged with anything at all. When someone is actually attacking you directly, whole different story. But otherwise, people need to realize that it's not worth assaulting someone over property. Take a picture. Leave the area, especially if police are not around. And if not, do not assault someone, if you're going to confront them.

This woman is a textbook example. If you are able to leave the area, do so. Don't inflame and otherwise escalate the situation. It's unfortunate that he countered her escalation with some serious battery. And he should get some serious time for that. There are just so many of these that go on.

She should be charged with the crime she committed. She should not get a ride because she's stupid or because her crime resulted in another crime against her. If you want to deter people, charge them with the crimes they commit and prosecute them for it. Then, reduce the sentences due to mitigating factors.

We're in agreement that excusing people for the crimes they commit because they're part of a group, whether advantaged or disadvantaged, only encourages more criminal actions.
