Judge Alito dissented from the decision to dismiss the case (along with Thomas and Gorsuch) calling it "baffling." He went on to say that the federal government’s theory at the center the case that Medicare-funded hospitals had a fcuking duty to protect the health of the pregnant mother in a life-threatening sitution “plainly unsound.”
Justice Ketanji Brown cautioned that the ruling wasn't a sign the Court was now concerned with emergency health care for women, it was just a delay (a ruling for the State of Idaho might've been awkward during an election year.)
